Terms of use

The Australian Researcher Cooperation Hub – India (ARCH-India) is an initiative of the Australian Government Department of Education, Skills and Employment and the Australia India Institute, University of Melbourne, with the aim of promoting research collaboration and discovery across Australia and India. ARCH-India has a firm commitment to freedom of speech and impartiality and is committed to the highest standards of integrity and professional conduct. We want our community to help highlight robust research that might otherwise be overlooked and to participate in collaborations to support each other’s research.   

    Registration

    You must register with ARCH-India to submit content. User-submitted content may take the form of researcher profiles and news content.

    To register, you must provide ARCH-India with your full details so that you can be confirmed as a legitimate member of a research or higher education institution or relevant industry organisation.

    Access to any authenticated areas will be by way of your registered user name and password and we allow you access to the authenticated areas of the site on the basis that:

    1. your email address and password are personal to you and may not be used by anyone else to access ARCH-India;
    2. you will not assist anyone who is not a registered user to gain access to any authenticated area of ARCH-India;
    3. you will not create additional registration accounts for the purpose of misusing the site or misleading other users; nor will you seek to represent yourself as another user; and
    4. you will comply with all ARCH-India terms and conditions, including these Terms of Use.

    Community Guidelines

    The purpose of ARCH-India is to promote research collaboration and discovery across Australia and India. Authors of submitted content have a duty to ensure that their work maintains the good name of ARCH-India as well as the research community.

    Registered users submit content for publication on ARCH-India in accordance with the following terms:

    1. you will engage with ARCH-India in a respectful manner and be open to collaborating or exploring ideas with respect to your topic/s of interest;
    2. you will not submit content that is obscene, offensive or illegal or that is deliberately intended to upset others;
    3. as a matter of general principle, you will not report research before it has been subjected to a recognised process of peer review;
    4. you will disclose any actual or potential conflict of interest, including information on sources of financial or in-kind support for your research and any personal benefits you may gain;
    5. you will take reasonable steps to ensure that any content you submit is not defamatory of any person or organisation (if you suspect that, or are unsure whether, content may be defamatory, you must tell us at the time you submit the material to us);
    6. you agree that your content is submitted under a Creative Commons licence (CC BY) and grant ARCH-India a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to publish and communicate to the public any submitted content in any format, including without limitation, print and electronic format. ARCH-India may permit other parties to publish any material you submit to us in any format, subject to attribution; and
    7. you warrant that any content you submit is your own original work and that you own the copyright and any other relevant rights. If you are submitting content that isn’t yours, you will have written proof of consent from the copyright holder to submit the content on their behalf.

    Moderation and Reporting Abuse

    All community interaction is subject to some level of moderation to ensure the spirit of the community guidelines and these terms of use are upheld. 
    Users should report any abuse, harassment, or threats they receive from other users to ARCH-India administrator (admin@arch-india.org). By raising issues, you will be adding to the ARCH-India community, making it a better place for all users.

    ARCH-India moderators may contact you by email in relation to your participation, especially where an issue comes up in relation to these community guidelines and terms of use. We ask that you comply with any advice or requests given by our moderators, as their role is to create a constructive environment for everyone who contributes to the ARCH-India community.

    Moderation of disputes will not be discussed on the website and we may not be able to respond to correspondence regarding specific moderation activity given the amount of user-submitted content on the site. Our moderation decisions are final.

    Our discretion

    Publication of submitted content will be at ARCH-India’s sole discretion and we reserve the right to remove published content at our discretion, including where:

    1. we are legally required to do so, for example if an article is found to be defamatory or in violation of copyright;
    2. the content contains major flaws or inaccuracies that warrant complete retraction and it is insufficient to correct factual inaccuracies;
    3. the content breaches copyright terms or licensing conditions; and
    4. we reasonably consider that the content poses a risk to someone's mental or physical health, or their safety.

    We reserve the right to make to make minor editorial additions or deletions to the content prior to publication, or to request that the author of the relevant content do so, or to refuse publication.

    We will remove user-submitted content when we reasonably determine that a contribution is perceived as breaching the community guidelines set out above.

    We reserve the right at any time and from time to time, to modify or discontinue, temporarily or permanently ARCH-India (or any part thereof) with or without notice.

    Termination of user account

    If, for any reason, we believe you have not complied with the ARCH-India terms of use or have acted against the expectations set out in the above community guidelines in an egregious, persistent or wilful manner, we may, at our sole discretion, cancel your ARCH-India account immediately and without notice.

    Should we decide to terminate your account, we will communicate this to your account’s registered email and your email address and password will become invalid on ARCH-India immediately.

    We reserve the right to remove your access to individual services completely if we believe you are abusing our services in any way.

    Intellectual Property

    The University of Melbourne reserves all rights with respect to ARCH-India, including all copyright, trademarks and other intellectual property rights in the information, data, text, graphics, images, website design, trademarks and logos displayed on ARCH-India.

    You may not, without our prior written permission, cause any of the content of the ARCH-India website to be framed or embedded in another website or use any trade marks displayed on the ARCH-India website without the express written permission of the relevant trademark owner.

    Indemnity

    You acknowledge that any breach of these terms of use may cause the University of Melbourne damage or loss. You agree to indemnify us in full and permanently against any third-party liabilities, claims, costs, loss or damage we incur as a result of your breach of these terms of use. You must act honestly and in good faith in your dealings with us and (if requested) you must provide us with reasonable assistance to settle, defend or investigate any third-party claims arising as a result of our publication of content that you submit to us.

    Our disclaimer

    ARCH-India accepts no liability for content that is submitted by users, neither are we responsible for its accuracy.

    The views expressed in content on our website are the personal opinions of the content author(s). They may not represent the views of ARCH-India, the University of Melbourne, or any other organisation unless specifically stated. ARCH-India attempts to provide a range of views from the academic and research community in both Australia and India.

    To the maximum extent permitted by law, ARCH-India provides no warranties or guarantees of accuracy or fitness for purpose, or that your access to the site will be continuous and without errors at all times.

    ARCH-India is provided on an “as is” and “as available” basis and we exclude all liability to you for loss or damage of any kind (however caused, including by negligence) arising from or relating in any way to the materials on this ARCH-India and/or your use of ARCH-India.

    ARCH-India takes no responsibility for third-party websites which are hyperlinked or referred to on ARCH-India. Access to third-party websites is at your own risk.
